These Terms of Service (“Terms”) govern your access to and use of the AIMS platform (“Service”), operated by AIMS (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service is intended for licensed real estate agents and brokerages operating in Canada. You must be at least 18 years of age and authorized to enter into binding contracts to use the Service. By using the Service, you represent that you meet these requirements.
AIMS is a lead management and marketing automation platform that enables real estate agents to capture, qualify, and follow up with leads via SMS, and to create and manage Meta (Facebook/Instagram) ad campaigns. Core features include:
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at sho@aimsuitedata.com if you suspect unauthorized access.
Each account belongs to an organization. All data — leads, conversations, campaigns, and listings — is scoped to your organization. We do not share your organization’s data with other organizations.
You agree to use the Service only for lawful purposes. You must not:
Housing Advertising Compliance: All Meta ad campaigns created through AIMS are automatically categorized under the HOUSING special ad category. This is a mandatory platform-level setting that cannot be removed. You are responsible for ensuring your ad content complies with all applicable fair housing laws.
SMS Consent: By using the SMS features of the Service, you represent that each lead you contact has provided prior express consent to receive SMS messages from you or your brokerage, including through submission of a lead form.
The Service integrates with third-party platforms including Meta (Facebook), Twilio, and Supabase. Your use of these integrations is subject to the respective terms of service of those providers. We are not responsible for the availability, accuracy, or actions of third-party services.
When you connect your Meta account, you authorize AIMS to access your Meta ad account and Facebook Page data solely for the purpose of creating and managing campaigns on your behalf. You may revoke this authorization at any time from within the Service (Settings → Meta Ads → Disconnect) or through your Meta account settings.
Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.
You retain ownership of your data. We do not sell your data or your leads’ data to third parties. Upon account termination, all organization data is deleted.
Access to the Service requires a paid subscription. Subscription fees, billing cycles, and payment terms are set out at the time of purchase. Fees are non-refundable except as required by applicable law. We reserve the right to change pricing with reasonable advance notice.
Failure to pay may result in suspension or termination of your account.
The Service, including its software, design, and content, is owned by AIMS and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service. You may not copy, modify, or distribute any part of the Service without our written permission.
You retain ownership of all content you upload or create through the Service, including listing photos, ad copy, and lead data. By uploading content, you grant us a limited license to use that content solely to provide the Service.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.
We do not guarantee the performance of any Meta ad campaigns created through the Service. Campaign results depend on many factors outside our control, including Meta’s algorithms, market conditions, and ad content.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AIMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless AIMS and its officers, directors, and employees from any claims, damages, or expenses (including legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) your violation of any applicable law or regulation; (c) your SMS communications with leads; or (d) your Meta ad campaigns.
Either party may terminate these Terms at any time. We may suspend or terminate your access to the Service immediately if you violate these Terms, fail to pay, or if required by law. Upon termination, your right to use the Service ceases and your data will be deleted in accordance with our Privacy Policy.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Ontario.
We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice in the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
